I wanted to flag another critical case that should be top-of-mind for every TA professional: the EEOC v. iTutorGroup, Inc. settlement.
This was the first lawsuit filed and settled by the EEOC specifically challenging AI hiring bias, and it was a direct hit on age discrimination. The core issue wasn’t a complex, proxy-driven algorithm, but simple, explicit instruction: iTutorGroup’s applicant software was programmed to automatically reject female candidates aged 55 or older and male candidates aged 60 or older.
This clear violation of the Age Discrimination in Employment Act (ADEA) resulted in a settlement paid to over 200 rejected applicants.
The key takeaway for our teams is stark: your Applicant Tracking System (ATS) or AI tool, no matter how “simple” its screening logic, is not exempt from federal anti-discrimination laws. Just because a rule is automated doesn’t make it legal. We must treat every piece of code and every screening parameter with the same legal scrutiny we apply to a human recruiter’s decision-making. Make sure your team is auditing every filter for explicit bias, especially those relating to age, to avoid becoming the next headline.
