
I’ve been diving into the recent legal cases shaping talent acquisition, and one thing is crystal clear: the responsibility for AI hiring bias falls directly on the employer. The case of Harper v. Sirius XM Radio, LLC is the perfect example. The plaintiff, Arshon Harper, alleges that Sirius XM’s Applicant Tracking System (ATS), powered by AI, systematically screened him out based on race, using seemingly neutral data points—like zip codes or specific educational institutions—as illegal proxies for his identity.
This isn’t about intentional malice; it’s about disparate impact. The AI, trained on historical hiring data, learned the biases of the past and is now amplifying them at massive scale. My biggest takeaway for fellow TA leaders? You cannot hide behind your vendor. When you deploy an AI screening tool, you own the outcome. “We trusted the vendor” is not a legal defense when discrimination occurs.
So, what should your team be doing right now? First, vet your vendors like never before. Demand proof of their bias testing and mitigation protocols. Understand what data sets their AI was trained on—if the past was biased, the algorithm will be too. Second, you must commit to proactive internal audits. Regularly check your AI’s rejection rates across all protected groups (race, age, sex) to catch adverse impact before the EEOC does. If the criteria your AI uses isn’t demonstrably job-related, it’s a liability waiting to happen. Let’s make sure we are using these powerful tools responsibly, with human oversight, to build truly equitable teams.
